If the top of CD has scratches and scuff marks would it effect it?

You are correct in stating that the read side (bottom) must remain scratch free to work properly. The top layer is thick enough to take on a small bit of print and some minor scratching. You still have to be careful with the top, though. If the ink bleeds through the top or a deep enough scratch appears, it will affect the playback.
